What is this Lawsuit About?

A Settlement has been reached in a class action lawsuit related to a data breach that occurred in or around December 2023, in which unauthorized individuals accessed personal information maintained by The May Institute, Inc., including names and Social Security numbers. The May Institute denies any wrongdoing.

The lawsuit is titled Sandler v. The May Institute, Inc., Case No. 2482CV00768, and is pending in the Norfolk County Superior Court for the Commonwealth of Massachusetts.

How do I know if I am in the Settlement Class?

You are part of the Settlement as a Class Member if your personal information may have been compromised as a result of the Data Breach that The May Institute discovered in or about December 2023.

The Class specifically excludes:

  • The Judge and Court staff assigned to this case
  • The May Institute’s current officers and directors
  • Individuals found criminally responsible for the Data Breach

Eligible Class Members were mailed notice of their eligibility by the Settlement Administrator. Class membership will be verified against that mailing list.

What Does the Settlement Provide?

Eligible Class Members may claim one of the following Settlement benefits:

  • Up to $400 for documented Out-of-Pocket Losses related to the Data Breach (e.g., fraud-related costs, credit freeze fees, notary, postage, or lost time)
  • Up to $2,500 for documented, unreimbursed monetary losses related to identity theft
  • Two years of 1-bureau credit monitoring with $1,000,000 in identity theft insurance
  • Up to $50 cash payment in lieu of all other benefits

To receive benefits, you must file a valid claim by August 7, 2025.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT

SUBMIT A CLAIM FORM BY AUGUST 7, 2025

This is the only way you may receive benefits from this Settlement.

OBJECT TO THE SETTLEMENT BY JULY 8, 2025 Write to the Court explaining why you do not agree with the Settlement.
EXCLUDE YOURSELF FROM THE SETTLEMENT BY JULY 8, 2025 If you don’t want to be legally bound by the Settlement or receive any benefits from it, you must exclude yourself. If you do not exclude yourself from the Settlement, you will remain in the Class and will give up the right to sue The May Institute, Inc. over the claims resolved in the Settlement.
ATTEND THE FINAL FAIRNESS HEARING You may ask the Court for permission for you or your attorney to speak about your objection at the Final Fairness Hearing. The Final Fairness Hearing will be held on August 7, 2025 at 3:00 P.M.
DO NOTHING You get no payment and you give up rights.
